Your contract terms and conditions are very reasonable. There is nothing worse when plans go up in smoke, and no one has any contractual agreement to sort it out. At least when contracts are signed niggle little things get sorted out without being niggle.

Hi there firstly it should be pointed out that I am not a lawyer and none of what I'm about to say should be relied on as legal advice, you should check with a lawyer before proceeding.

So far as I am aware in the situation you describe it here is no obligation for you to return the money. They have paid you money for a service, if they don't need the service that does not automatically entitle them to a refund. If they have sent you money without any form of contract in place that could well constitute a free gift which you don't have to return. It is also possible that by payment of monies they have legally accepted your contract as a "contract of adhesion" since these were the terms under which you offered to do business with them. Look into distance selling regulations, conditions of sale, adhesion contracts and refund law in your area.

However if you do not refund (even if legally entitled not to do so) you may lose more in the long run through word of mouth and loss of reputation. Generally at A Matter of Photography we would try to refund a customer where possible even if not obliged to as we value our professional reputation. Why not go back to the people you turned down and say that you are now available.

Help needed! We have a similar contract in force, however have a situation where the person booked their wedding photography with us over the phone to secure the date, paid the deposit by card, but did not return the signed contract which we emailed her. Over 30 days have passed and she has contacted us asking to cancel the booking and return the deposit to her. She is using the fact the she has not signed the contract as her leverage for the deposit back. Frustratingly we actually had someone contcat us for the same date and we turned them away so have definitely lost out on business. Does anyone know where we / shes stands on this? Thanks Lou

I am getting hitched in 5 months and have a serious case of the heebie jeebies! i have yet to find a wedding ring for my bride to be. i'ts not a matter of finance, it's simply because i'm finding the huge selection quite overwhelming, what if i pick the wrong one? I mean this is something that they will wear day in day out for the rest of their life (if all goes well, lol.) do you have any advice that could help me narrow down my selection?
